A delegation led by Farhad Abdullayev, Chairman of the
Constitutional Court, participated in the 7th Congress of the Association of
Asian Constitutional Courts and Equivalent Institutions, held in Samarkand,
Uzbekistan, on October 1–2. The congress was dedicated to the subject of
constitutional justice in the context of digitalization and artificial
intelligence.
At the official opening of the event, a letter from
the President of the Republic of Uzbekistan, Mr. Shavkat Mirziyoyev, addressed
to the Congress participants, was announced.
After the opening speeches, in the practical part of
the event, issues were considered in various areas of the Association's
activities, reports were heard, an exchange of views took place on the
expansion of the Association, the development of co-operation with other
international organizations operating in the field of constitutional justice,
as well as on the draft Samarkand Declaration.
Subsequently, reports were presented at the plenary
sessions on the topics of “Constitutional justice in the context of
digitalization and artificial intelligence: legal safeguards for ensuring
judicial independence, the protection of human rights, and the rule of law” and
“Digitalization of constitutional justice and the application of artificial
intelligence in the exercise of constitutional oversight: opportunities, legal
limits, and safeguards,” followed by extensive discussions on pressing issues facing
constitutional justice in the modern era. During the discussions, attention was
focused on the opportunities created by digital technologies and artificial
intelligence in the administration of constitutional justice, the legal grounds
and limits for the application of these technologies, and issues regarding the
reliable safeguarding of human rights and freedoms, the rule of law, and
judicial independence.
At the congress, Farhad Abdullayev, Chairman of the
Constitutional Court of the Republic of Azerbaijan, delivered a presentation titled
"The limits of applying artificial intelligence as an analytical tool in
the drafting of judicial acts, including decisions of the Constitutional
Court."
As part of the visit, Azerbaijan’s Constitutional
Court initiated a working meeting of the constitutional courts of the
Conference of Constitutional Jurisdictions of the Turkic World (TÜRK-AY), where
participants discussed prospects for cooperation among member courts and future
areas of activity.
Also, at meetings with the delegation of the
Constitutional Court of the Republic of Azerbaijan and the delegation headed by
the Chairman of the Constitutional Court of the Republic of Uzbekistan Mirza
Ulugbek Abdusalomov, issues of developing co-operation between the two
countries in the field of constitutional justice, as well as expanding the
exchange of experience were discussed.
The Samarkand Declaration was adopted at the conclusion of the Congress.
