Plenum
of the Constitutional Court of the Republic of Azerbaijan, chaired by Farhad Abdullayev,
held a regular session.
At the court session was examined the constitutional
case based on the request of the Prosecutor's Office of the Republic of
Azerbaijan on interpretation of some provisions of the “Note” parts of Articles
144, 199, 214, 214-1, 214-3, 215, 228, 229, 274, 278 and 283-1 of the Criminal
Code of the Republic of Azerbaijan.
Having heard the report of Judge K.Shafiyev,
studied and discussed the reports of interested parties – Prosecutor's Office of the Republic of Azerbaijan and
Staff of the Milli Majlis (Parliament), the conclusions of specialists – Criminal Board
of the Supreme Court of the Republic of Azerbaijan, Criminal Board of the Baku
Court of Appeal and the Bar Association of the Republic of Azerbaijan, opinion
of expert – Associate Professor of the
Department of Criminal Law and Criminology, Faculty of Law, Baku State
University, M.Bayramova, the Plenum of Constitutional Court of the Republic of
Azerbaijan adopted decision.
The decision states that a person who has committed the acts provided for in the "Note" parts of Articles 144, 199, 214, 214-1, 214-3, 215, 228, 229, 274, 278 and 283-1 of the Criminal Code of the Republic of Azerbaijan shall be exempted from criminal liability under that article. If a person's actions also constitute another crime, he or she is held liable only for that crime.
The decision comes into force from the date of its publication, is final, and may not be cancelled, changed or officially interpreted by any institution or official.
