Plenum of the Constitutional Court examined the constitutional case on interpretation of Article 522 of the Criminal Procedure Code

Plenum of the Constitutional Court of the Republic of Azerbaijan, chaired by Farhad Abdullayev, held a regular session.

At the court session was examined the constitutional case based on the inquiry of the Baku Court on Grave Crimes on interpretation of Article 522 of the Criminal Procedure Code of the Republic of Azerbaijan in terms of the requirements of Part V of Article 125 and Part I of Article 60 of the Constitution of the Republic of Azerbaijan.

Having heard the report of Judge R.Gvaladze, studied and discussed the reports of interested parties – Baku Court on Grave Crimes and Staff of the Milli Majlis (Parliament), the conclusions of specialists – Supreme Court, Prosecutor's Office of the Republic of Azerbaijan, Baku Court of Appeal, Bar Association, opinion of expert – Head of the Department of Criminal Procedure of Baku State University, Doctor of Law, Professor F. Abbasova, the Plenum of Constitutional Court of the Republic of Azerbaijan adopted decision.

The decision states that in accordance with the requirements of Part V of Article 125 and Part I of Article 60 of the Constitution of the Republic of Azerbaijan, it is inadmissible for the court to recognize the verdict of a foreign court in a manner other than Article 522 of the Criminal Procedure Code of the Republic of Azerbaijan and to count the sentence served by the verdict of a foreign court towards the term of sentence to be imposed on the accused when imposing a sentence on him/her for a set of crimes.

The decision comes into force from the date of its publication, is final, and may not be cancelled, changed or officially interpreted by any institution or official.
